Teen's Rape Charge Could Drop With Good Behavior
Judge says a year of meeting conditions could lead to a dismissal of sexual assault charge.
If he meets a list of conditions over the next year, a 16-year-old Mt. Olive boy could have a charge of sexual assault of an intoxicated girl dismissed, a judge ruled Wednesday.
The teen, whose name is being withheld because of his age, was granted a “deferred disposition,” by Judge Micheal Paul Wright, according to nj.com. The teen admitted to a fourth-degree charge of invasion of privacy, but his attorney maintained that the sexual contact was consensual in September 2012.
Mt. Olive Police received a call on a Saturday night in September from a parent who feared her daughter was drunk at a Flanders residence, police reported last year.

The police investigation revealed the 16-year-old resident and his 15-year-old friend sexually assaulted the girl "as she was lying in a bedroom, incoherent due to the alcohol consumption," police said.
The second teen pleaded guilty last week to a reduced charge and received a one-year suspended sentence, nj.com reported.

If the 16-year-old, who was 15 at the time of the incident, stays out of trouble for the next year, Wright said, “one year from now I will sign an order dismissing this,” nj.com reported.
The teen pleaded guilty to a fourth-degree charge of invasion of privacy.
